• Use the Services for unlawful purposes or in violation of any applicable local, national, or international laws. We are not liable for how clients use the Services, but we expect compliance with all relevant legal requirements.

• Interfere with or disrupt the functionality of the Services.

• Reverse engineer, decompile, or disassemble any part of the Services.

• Use automated systems or tools to access the Services without our prior written consent.

2. Payment and Subscription

2.1 Fees and Billing

• By subscribing to our Services, you agree to pay the applicable fees as outlined at https://crm.oasbit.com/pricing/.

• myOasbit CRM incurs additional usage-based fees on top of the subscription fee, which are detailed at https://crm.oasbit.com/pricing/. Usage fees are non-refundable.

• myOasbit CRM uses a wallet system. To incur usage fees, your wallet must be prepaid.

• Phone numbers and domains purchased through myOasbit CRM are non-refundable but can have their renewals canceled. Phone numbers can be ported to Twilio, and from Twilio to other providers. 2.2 Subscription and Refund Policy

• Subscriptions automatically renew at the end of the billing cycle unless canceled through your account settings.

• We offer a 30-day money-back guarantee for our monthly plan. For our annual plan, refunds are available for unused months. For pricing details, visit https://crm.oasbit.com/pricing/.

• Refunds, if approved within the 30-day window for monthly plans or for unused months of annual plans, will be processed to the original payment method within 10 business days. To request a refund, contact our support team at billing@oasbit.com.

• Usage fees, phone numbers, and domains purchased are non-refundable under any circumstances.

2.3 Taxes

• You are responsible for any applicable taxes, duties, or levies associated with your use of the Services, as required by the laws in your jurisdiction.

3. Intellectual Property

3.1 Ownership

• All content, software, and materials provided through the Services are owned by myOasbit or its licensors.

• Websites built using myOasbit Web Builder are hosted on Oasbit servers and are non-transferable. Only websites built on WordPress can be transferred.

• You may not use, reproduce, or distribute any content without our explicit permission.

3.2 License

• We grant you a limited, non-exclusive, non-transferable license to use the Services for personal or business purposes in accordance with these Terms and applicable laws.

4. Support Services

• myOasbit CRM offers unlimited support calls. Every account includes support for creating two workflows and uploading contacts. Additional setup will be billed separately.

5. Termination

5.1 Termination by You

• You may stop using our Services and terminate your account at any time.

5.2 Termination by Us

• We may suspend or terminate your access to the Services if you violate these Terms, engage in any behavior that harms our Services, reputation, or users, or violate any applicable laws.

5.3 Effect of Termination

• Upon termination, your access to the Services will cease, and any data associated with your account may be deleted, subject to applicable data retention laws in your jurisdiction.

6. Disclaimers and Limitations of Liability

6.1 Disclaimer of Warranties

• The Services are provided “as is” and “as available” without any warranties, express or implied, to the extent permitted by applicable law.

• We do not guarantee that the Services will be error-free, uninterrupted, or meet your specific needs.

6.2 Limitation of Liability

• To the fullest extent permitted by applicable law, myOasbit shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services.

7. Indemnification

You agree to indemnify and hold myOasbit harmless from any claims, damages, losses, or expenses arising out of your use of the Services, violation of these Terms, or infringement of any third-party rights, including violations of applicable local, national, or international laws.

8. Governing Law and Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law principles, unless otherwise required by the mandatory laws of your jurisdiction.

• Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in Ontario, Canada, in accordance with the rules of the International Chamber of Commerce (ICC), unless local laws in your jurisdiction mandate an alternative dispute resolution process. You agree to waive any right to participate in a class action lawsuit against myOasbit.

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on our website and updating the effective date. Your continued use of the Services constitutes acceptance of the updated Terms.
